Well, that's bad in that case, but could make sense, you know, like happened in this case: http://www.theverge.com/2015/3/31/8320601/super-mario-64-remake-nintendo-takedown And that's a mere remake, I can't imagine with a new whole recreation like this. Luckily I downloaded the game, but it could be a great shame for DJCoco, :( I understand the copyright reasons and beyond all of that, but at least they shall let some fantastic works like this too see Nintendo's potential through its own characters, etc. Also the fangame is a pretty well done in almost all senses (if somehow mocks the image of the company, now that's surely bannable), as long as is cleverly stated that is not officially made by them, of course.
